Rule 23 Guidelines and Best Practices

The Bolch Judicial Institute at Duke Law School held a conference in 2016 to identify standards and best practices for the bench and bar to implement in light of pending amendments to Rule 23, which go into affect December 1, 2018.

Class Action Settlement Guidelines and Best Practices was drafted by 38 prominent defense and plaintiff practitioners and experts experienced in class action litigation, including HF Media President Jeanne Finegan.  Jeanne has more than 25 years of communications and advertising experience and is a distinguished legal notice and communications expert.

SUMMARY OF CHANGES TO RULE 23

• Requires counsel to provide additional information ahead of preliminary settlement approval
• Permit notice by electronic means
• Impose limitations on compensating objectors
• Clarify final-settlement criteria

This comprehensive document, created as an aid for both the bench and the bar, is intended to add further guidance to what is provided in Rule 23.
